These Terms of Service ("Terms") govern your access to and use of the Artemis Wholesale platform ("Service") operated by Artemis Wholesale Investments ("we," "us," or "our"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
Artemis Wholesale is a software-as-a-service platform that provides real estate wholesalers with tools including live property search, comparable sales data, skip tracing, AI-powered deal analysis, contract generation, and direct mail campaign management. The Service is intended for lawful real estate investment and wholesaling activities only.
You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@artemiswholesale.ltd of any unauthorized access.
You may not share your account with others or allow multiple individuals to access the Service using a single set of credentials. Team seat features are available on Pro plans for multi-user access.
Free Trial. New accounts receive a 7-day free trial with Solo-plan feature access. No payment information is required during the trial period.
Paid Subscriptions. After your trial, continued access requires a paid subscription. By subscribing you authorize us to charge your payment method on a monthly recurring basis at the rate for your selected plan.
Cancellation. You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. We do not issue refunds for partial months.
Price Changes. We may change subscription prices with 30 days' advance notice. Continued use after the notice period constitutes acceptance of the new pricing.
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree not to use the Service for any unlawful purpose or in any way that violates applicable federal, state, or local laws and regulations.
Our collection and use of personal information is described in our Privacy Policy. By using the Service you consent to our data practices as described therein.
You retain ownership of all data you input into the Service (property records, pipeline data, contacts). You grant us a limited license to process that data solely to provide the Service to you.
The Service integrates with third-party providers including BatchData (property data and skip tracing), Anthropic (AI analysis), Stripe (payment processing), Mapbox (mapping), Lob (direct mail), and Resend (email delivery). Your use of these integrations is subject to the respective providers' terms of service. We are not responsible for the accuracy, availability, or conduct of third-party services.
The Service, including all software, design, text, and graphics, is owned by Artemis Wholesale Investments and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer any software, without our prior written permission.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PROPERTY DATA, COMPARABLE SALES, SKIP TRACE RESULTS, OR AI-GENERATED ANALYSIS ARE ACCURATE, COMPLETE, OR CURRENT. YOU ARE SOLELY RESPONSIBLE FOR INDEPENDENTLY VERIFYING ALL INFORMATION BEFORE MAKING REAL ESTATE DECISIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTEMIS WHOLESALE INVESTMENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) $100.
We may suspend or terminate your account at any time for violation of these Terms or our Acceptable Use Policy, with or without notice. You may terminate your account at any time by canceling your subscription and contacting us to request deletion. Upon termination, your right to access the Service ceases immediately.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
We may update these Terms from time to time. We will notify you of material changes via email or a notice in the dashboard. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
